1. Subject
The general terms and conditions of sale which follow outline the contract of the on line sale of products and services offered by bandavej of Vaglio Tessitore Filippo , in Biella- Via Filippo Juvarra n.22, CF and registered to CCIAA VGLFPP65D12A859R, P.IVA 01721700027, REA 158999 via the web site www.bandavej.com (website to follow)

 

2. Terms of payment
bandavej.com provide three methods of payment, which can be chosen when finalizing the order :

Cash on delivery : a supplement of 6 Euros will apply
Payment on line with credit card via Paypal
Payment via Bank Transfer

3. Delivery
The product purchased will be delivered by bandavej to the address as indicated by the client. bandavej is not responsible for any delivery problems caused by the client giving wrong information . bandavej will try to deliver the goods in within 48/72 hours from the first working day following the receipt of the order. this term is only a guideline and cannot be guaranteed as availability of products or force major could cause a variation of the time for dispatching the goods. if a delay is experienced the client can contact the “online client service” , bandavej and we will check the reason for the delay without incurring any responsibility . On receiving the order the client should make sure that the parcel is neither damaged nor wet or in any other way not recognised as a standard postal parcel.
If the parcel remains for more that 5 working days in the courier's warehouse because it is undeliverable to the address given at the time of the order, the order will be automatically cancelled. Any possible extra fees for the extra time of holding the parcel in the courier's warehouse will be charged to the client


4. General Terms and Conditions of sale acceptance
4.a After sending the online order the customer is declared to be a buyer under the law lgs 206/2005 and accepts and agrees to abide by the general payment terms and conditions of bandavej and accept all of the information given under the law as mentioned above.
4.b The customer is committed to save or print the sales terms and conditions of bandavej. such terms can be changed or modified at any time and will be valid from the date of publication. the clients will abide by the terms and conditions on the date of the order sent.
4.c If bandavej does not reply to any queries or misunderstandings from the part of the customer this does not mean in any way that they accept such queries or misunderstandings.

5.Buying and selling conditions
3.a In observation of the Legislation D.LGS 9/04/2003 N.70 in relation to certain aspects of the shopping on line, the PURCHASE of the products available as shown and described on line, in the related cards, is done by the client at the price shown on the web site at the time of confirmation of the order plus the shipping charges and payment fee (for cash on delivery only, 6€) seen at the time of purchase. before confirming the order the client will be able to see a summary of the purchase of each single item along with the total amount including the shipping charges; the client will also have to accept and agree to the terms and conditions for sale and privacy. after confirming the purchase the client will receive an email with all the order details, total amount and the date .
4.b The order file will be saved into the bandavej database for the time necessary to despatch the order in accordance with the law.
4.c The price for each item is in Euro (€) and are inclusive of VAT (IVA). The price of each item can change and be modified at any time and without notice; the price of the item purchased by the client will be the same as that published on the website at time of confirmation.

6. Customs duties for delivery abroad
The order could be liable to customs duties or taxes according to the country of delivery. Bandavej cannot anticipate such fees and if necessary the client will have to pay the fee directly to enable the clearance of the goods. For further information regarding customs and duty regulations please contact your local customs office.

7. Goods warranty and compliance
Bandavej, in relation to goods offered online, guarantees a legal warranty according to the law ex art. 128 e ss lgs 206/2005. Goods warranty and compliance is guaranteed only if the goods have been used without negligence and if all of the technical and legislative information provided have been respected. According to the computer settings of each clients, please note that colours and images can be different from the actual product. Any defect with the products has to be declared within two months of the discovery. Bandavej reserves the rights to verify the goods and to replace it only after an appropriate verification has taken place. The delivery fee for the replacement is bandavej's responsibility. Before returning a faulty product the client must contact customer service via email: buy@bandavej.com , descibing the nature and the fault of the product. The client will then receive further instructions on how to proceed.

8. Right of withdrawal
8.a. A client that has bought goods on line , can withdraw from the contract without any penalty and without specic reasons within 10 working days from the date of receiving the goods under the law art 64 e ss d.lgs 206/2005.
8.b The returned goods must be in perfect condition with its original packaging, labels and in the same condition as at the time of receiving.
8.c Please note that the parcel for the returned goods, must be correctly packed and must include a copy of the invoice and to be sent to: Bandavej – Via Filippo Juvarra n.22 - 13900 Biella- BI. The shipping fees are the client 's responsibility.
8.d Bandavej will make sure to reimburse the Client , less the shipping fee, in as short a time as possible and definitely within 30 days of the date of the communicated withdrawal. This applies as long as the goods have been returned under the policy as stated in the previous paragraphs. Please note that before returning goods you will need an authorization which you can request at the following email address: info@bandavej.com. Bandavej will send a return code for the goods to be returned and a request for the bank details of where to send the reimbursement. (iban, account number of the holder invoice)
It is advisable to use a courrier to return goods as this makes it possible to track the delivery. In any case where bandavej does not receive the goods, there will be no reinbursement.

8.e Exemption applied as per law art. 55 D. Lgs 206/2005, and in particular for items that have been tailor-made or personalized.

9. Jurisdiction
9.a The contract will be regulated under italian law. in case of any doubt in relation to its validity,the competence will be to the judge of the place of residence or domicile of the consumer, if they are in the state.
